Plylab’s Terms and Conditions
The following general terms and conditions are applicable to all orders of cabinetry and its components, accessories, appliances (“the cabinetry”) manufactured and sourced by PlyLab Ltd. No other terms, conditions or deviations from these general terms and conditions shall be binding unless accepted in writing by an authorized representative of PlyLab.
1. Customer Obligations
1.1 Customer Definition
Customers can be individuals or entities, including companies, government agencies, and contractors. If you are a building company or tradesman, both you and your business are considered customers under these terms.
1.2 Compliance with Standards
Customers must ensure compliance with standards for appliances, electrical work, and other code requirements. If modifications (e.g., access holes) are needed before manufacturing, accurate measurements must be provided. Changes requested after design approval will be subject to the fee specified in clause 7.1
1.3 Design Confirmation
Before signing the final submission, it is the customer’s responsibility to confirm that the design meets all specifications.
1.4 Communication
All communication with PlyLab should be conducted via email. Any phone calls or meetings must be confirmed by email.
1.5 Delivery and Installation
Customers must arrange for delivery, storage, and installation of the cabinetry.
1.6 Fixtures and Fittings
Customers should order appliances, taps, sinks, and fixtures in advance. While we will design cabinetry to fit specified appliances, we can't guarantee perfect fitment without the appliances on-site. PlyLab accepts no responsibility for damaged or inoperable appliances delivered to PlyLab at a customer's request. After testing, customers must arrange pickup within a week to avoid storage fees. All fixtures should be installed by qualified tradespeople.
1.7 Notification of Delays
Customers must promptly inform PlyLab of any subcontractor delays and make necessary arrangements for the storage of finished products.
2. Design, Quotation and Acceptance
PlyLab will design cabinetry based on your requirements. The design remains PlyLab’s property until full payment is received.
2.1 Design Process
Designs will meet customer specifications within PlyLab's manufacturing capabilities.
2.2 Specification Drawings
Plans will focus on cabinetry; external plumbing, electrical work, and other components are not included, and if referenced, are for guidance only.
2.3 Acceptance
To accept the quotation, sign and return it with the attached plans. By doing so, you confirm the quotation and design are of acceptable quality and agree to proceed based on these specifications. Quotations are valid for 30 days.
2.4 Final Outcome
Installation results may differ from designs due to site conditions.
3. Manufacturing Process and Timeline
3.1 Ordering Materials and Production
Materials will be ordered, and manufacturing will commence simultaneously after signing the quotation and plans, and upon receipt of a 40% commitment fee.
3.2 Design Tolerances
Designs are indicative; final tolerances are within 1–4 millimeters.
3.3 Timeline and Delay Management
PlyLab is not responsible for delays outside its control, including but not limited to supply chain issues. PlyLab will communicate any changes as soon as possible and is not liable for costs or losses due to delays. Customers must promptly inform us of any subcontractor delays and arrange storage for finished products.
4. Final Review and Defects
Once the cabinetry is ready, the customer will be invited to inspect it. Any defects noted during this review will be recorded for correction. Once satisfied, you will sign to accept the goods. If any issues arise during installation due to third-party work, those are covered under the product warranty. PlyLab can assist with finishing tasks around the cabinetry at a rate of $1,000 per worker per day.
5. Installation
5.1 Installation Quote
The installation quote estimates the cost but is subject to change based on unseen jobs and additional parts or extras selected by the customer.
5.2 Risk
The cabinetry remains at PlyLab's risk until delivery. Installation shall be completed within approximately 4 to 8 weeks of site measurement completion, subject to material availability. If installation dates are rescheduled and the cabinetry needs to be stored, customers must organize storage.
5.3 Installation Process
Customers must allow for installations between 7:00 a.m. and 5:00 p.m., and no other trades may work on-site during this time.
5.4 Appliance Installation
Customers must order appliances in advance. Final adjustments to appliances will be charged at an undefined rate.
5.5 Site Access
The customer must ensure that the site is accessible for delivery and installation. Any difficulties could lead to scratches or chips on cabinetry.
6. Price and Payment Structure
6.1 Payment Structure
Design Fee: An $800 design fee is required, which will be credited against your final kitchen invoice. This fee includes:
A consultation with our plywood expert to refine your vision.
Detailed technical drawings, including plans, elevations, and perspective views.
Design revisions until all details are finalized.
Assistance with material and colour selection.
An itemized quote for complete transparency.
Payment Schedule:
40% due upon acceptance of the quote.
40% due at substantial completion of the work.
20% due upon final completion.
6.2 Price of Cabinetry
The price of the cabinetry shall be the price stated in the latest quotation, together with all extras selected by the customer and subject to variation. The customer has accepted the price of the ordered product(s) by signing the order. The price excludes removal of existing cabinetry, plumbing, electrical, plastering, painting, and building alterations. Prices are subject to change. If any material or hardware has been priced by our supplier, the cost will be added to the final invoice.
6.3 Ownership
PlyLab retains ownership of the cabinetry until full payment is made.
7. Variations and Cancellation
7.1 Variations
Any changes to the signed order require a signed change order and will require the payment of a $300 fee to cover the cost of additional design, administration, and manufacturing work.
7.2 Cancellation
Once the design is signed, you cannot cancel for a "change of mind." The deposit will be retained by PlyLab.
8. Warranty
PlyLab’s craftsmanship is guaranteed for 10 years from the date of manufacturing. Any defects related to the craftsmanship will be resolved by PlyLab. The hardware and electric components are covered by the supplier's warranty, and PlyLab won’t cover the cost of replacing these components. However, if the shipping or installation service damages a product, we will, for the mentioned fee in clause 6, assist in replacing the damaged product. LED strips have a 2-year warranty from the manufacturer. In the event that an LED needs to be replaced, PlyLab will organize the replacement part at no cost. However, the installation of it will be charged at $100 per hour with a minimum charge of $1,000.
9. Customer Reliance
Information in advertising is a general guide. Verify accuracy yourself. In particular, the customer acknowledges that colour samples for a number of the products may vary.
10. Miscellaneous
If specific materials are unavailable, PlyLab may substitute comparable materials of similar quality. Any cost differences will be reflected as an additional charge or deduction from the contract price. Leftover materials will be discarded after the job is complete. If any individual part of this contract is invalid, the rest remains in effect.
11. Limitations
PlyLab may help to coordinate contractors; however, it does not manage renovations or oversee other contractors' work and does not accept liability for their actions.
12. Governing Law
These terms are governed by New Zealand law. If PlyLab cannot complete installation due to your actions, final payment is due immediately.
